Is Constitutional Carry Coming to Georgia?

Constitutional Carry is the idea that the 2nd Amendment gives all law-abiding Americans the right to carry a firearm or other weapon for their defense and, thus, that those citizens don’t need a permit to carry. As a reminder, the 2nd Amendment provides that:

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

The Constitutional Carry advocates are firm believers that the part saying “the right of the people to keep and bear Arms, shall not be infringed” means just that: that the right to bear arms cannot be infringed by the state.

Such a view of the 2nd Amendment and carrying firearms has become more and more popular in America, with many states (24) having adopted Constitutional Carry laws and restoring the right of citizens to bear arms without government interference.

Well, a 25th state might soon join the fold: Brian Kemp’s Georgia.

That’s because the legislature could soon pass a constitutional carry bill, as the Georgia Senate tweeted out, saying:

Motion to agree to the House Substitute to SB 319 passes with a vote 34 to 22 #gapol #gasenate

That tweet means that the Georgia Senate agreed to pass the House version of the Constitutional Carry bill, an announcement that, if accurate, means that such a bill is soon headed to Governor Kemp’s desk.

He reacted positively on Twitter, responding to the Senate Press Office tweet by saying “I look forward to signing the Georgia Constitutional Carry Act of 2021 into law soon and fulfilling another promise I made to the voters of this state.”

He also tweeted out a message of his own on the subject, saying:

For law abiding Georgians, their carry permit is the 2nd Amendment. I’m proud to have worked alongside leaders in the General Assembly to get Constitutional Carry over the finish line, and I look forward to signing it into law.

If Kemp is telling the truth and does intend on signing the Constitutional Carry bill, then Georgia will soon join Alabama, Alaska, Arizona, Arkansas, Idaho, Indiana, Iowa, Kansas, Kentucky, Maine, Mississippi, Missouri, Montana, New Hampshire, North Dakota, Ohio, Oklahoma, South Dakota, Tennessee, Texas, Utah, Vermont, West Virginia, and Wyoming.

That’s welcome news to many 2nd Amendment advocates. NRA Chairman Wayne LaPierre, for example, said:

“The success of the carry movement in America cannot be denied at this point. When Gov. Brian Kemp signs this landmark legislation, half of America will protect the right to carry as an inherent and inalienable right.

“This milestone really shows the divide between Washington and the rest of the country. While the majority of states pass laws that ensure their constituents’ Second Amendment and self-defense rights are protected, the Biden administration fails to prosecute criminals and tries to enact gun control schemes and undermine self-defense laws. In essence, they’re overprotecting and indulging criminals while penalizing good Americans.”

If Kemp is telling the truth, then half the states in the union will now be recognizing that “shall not be infringed” means just that. Good.
