It’s unlikely that the Japanese courts engage in epic trolling of loser activists. Nevertheless, there is an added bonus hearing that the postmodern concept of gay marriage is not a constitutional right smack dab in the middle of Pride Month.
In its ruling, an Osaka-based court determined that a ban on gay marriage was not a violation of Japan’s consitution and agreed with the government’s central argument that the purpose of marriage was reproduction. Only in America is marriage seen only as a vehicle for limitless sexual gratification.
Amazingly, it didn’t seem like this argument needed to be made, least of all on a constitutional level. The Japanese constitution makes it abundantly clear that there is only one reason for, and one type, of marriage. It reads, in part:
“Marriage shall be based only on the mutual consent of both sexes and it shall be maintained through mutual cooperation with the equal rights of husband and wife as a basis.”
What’s more, the court went a step further by declaring that the institution of marriage served a “pragmatic purpose” of “protecting men and women to bear children and raise them.”
What’s not to get?
It’s as if a time traveler from 21st-century America looked at the destruction wrought by unhinged leftist activism and went back to post-World War Two Japan to get ahead of the coming LGBTWXYZ tsunami. The fact that Japanese marriage stresses both a heterosexual union and the dual purpose of raising children and maintaining social cohesion is a comforting notion in today’s anything-goes climate.
And, of course, legal arguments aside, it’s not as if Japan is some bigoted, homophobic nation. Just as compelling, commonsensical arguments can be made against gay marriage in the States by decent people who treat everyone with kindness, so too does Japanese society operate on two levels: One where marriage is an obvious vehuicle for societal continuation and where individuals are treated with respect. To that end, the Daily Wire writes:
“Although Japan bans same-sex marriage, local governments have been recognizing same-sex partnerships for years. The city in which the district court lies, Osaka, offers that recognition. It was also first in the country to recognize two gay men as foster parents in 2017.
Last week, the government of Japan’s capital, Tokyo, adopted legislation to grant recognition certificates to same-sex couples starting in November. Out of Japan’s 47 prefectures, nine now recognize same-sex partnerships. About a quarter of Tokyo’s 62 municipalities were already granting those certificates.
Certificate acknowledgement ensures that same-sex couples enjoy certain marital benefits like hospital visitation rights. However, perks like joint tax filing and spousal inheritance are reserved for married couples.”
Talkshow host and author Dennis Prager often says society needs standards in the macro and compassion in the micro. Leftists are just too stupid to walk and chew gum at the same time.
