AOC once again proved herself to be a Congresswoman with a brain devoid of wrinkles in an embarrassing statement she gave about the legislature and executive needing to put the Supreme Court “in check”, a statement that shows her complete lack of understanding about how the US “checks and balances” system works. As you can hear, AOC, speaking on the relationship between the Supreme court and legislature during an appearance with Colbert, said:
“It is the responsibility of the president and Congress to put the Supreme Court in check because they have delegitimized themselves.”
That’s completely wrong. The court’s role has long been, since Justice Marshall’s opinion in Marbury v. Madison, judicial review; it determines if something is Constitutional or not, not vice versa.
AOC must have never learned that, or just didn’t care. She went on, during the Colbert interview, to attack the Supreme Court, saying that it denied “the human and civil rights of any pregnant person or person that could become pregnant in the United States of America.”
She also called for Biden to expand the Supreme Court, saying:
“I believe that President Biden should entertain expansion of the Supreme Court. I believe that he should forcefully come out in ending the filibuster of the United States Senate. I believe that he should call on Congress to repeal the Hyde Amendment.”
This wasn’t AOC’s first attack on the Supreme Court since the Dobbs ruling came out. She also attacked the conservative justices for “lying” during their confirmation hearings, saying:
“I believe lying under oath is an impeachable offense. I believe that violating federal law in not disclosing income from political organizations, as Clarence Thomas did years ago, is also potentially an impeachable offense. I believe that not recusing from cases that one clearly has family members involved in with very deep violations of conflict of interest are also impeachable offenses.”
She then added that “I believe that [impeachment] is something that should be very seriously considered, including by senators like Joe Manchin and Susan Collins.”
Still, her comment about the legislature and executive branch “checking” the Supreme Court is probably her worst and most ridiculous, as it exposes her complete lack of understanding about how our system of government works.
The job of the Supreme Court is to judge the constitutionality of laws and executive actions and, when necessary, to check them, meaning that her “the responsibility of the president and congress to put the Supreme Court in check” comment is exactly backward.
She’s also not the only far-left Democrat attacking the Supreme Court. President Biden did as well at a press conference for the G7 summit, during which he said:
“The one thing that has been destabilizing is the outrageous behavior of the Supreme Court of the United States, in overruling not only Roe v Wade, but essentially challenging the right to privacy.
