When Chief Justice John Marshall released his Worcester v. Georgia decision, one that infuriated President Andrew Jackson, Jackson supposedly remarked “John Marshall has made his decision; now let him enforce it.” Well, now Biden is echoing that and, with a new executive order, effectively saying “Justice Alito has made his racist, mean decision; now let Cornpop do…you know…the thing.”
That executive order, about which Team Biden released a fact sheet this morning, aims to federalize protections of abortion just weeks after Justice Alito’s decision returned the issue to the states, where it belongs.
Introducing the issue in the fact sheet, Team Biden claims they’re singing the order because the Supreme Court’s Dobbs decision will somehow affect women of color disproportionately, saying:
Two weeks ago, the Supreme Court issued a decision that overturned Roe v. Wade and eliminated a woman’s Constitutional right to choose. This decision expressly took away a right from the American people that it had recognized for nearly 50 years – a woman’s right to make her own reproductive health care decisions, free from government interference. Fundamental rights – to privacy, autonomy, freedom, and equality – have been denied to millions of women across the country, with grave implications for their health, lives, and wellbeing. This ruling will disproportionately affect women of color, low-income women, and rural women.
Wrong on two counts: after the ruling in Dobbs, the supposed “right” to abortion is no longer a right, much less a fundamental right, and the ruling applies to everyone equally, not just to certain groups that tend to vote democrat.
The fact sheet then went on to note that Congress should be dealing with the issue, but it isn’t (perhaps because Congress understands federalism), so Biden is usurping that power and using an executive order to do what he thinks the legislature should be doing. In the fact sheet’s words:
President Biden has made clear that the only way to secure a woman’s right to choose is for Congress to restore the protections of Roe as federal law. Until then, he has committed to doing everything in his power to defend reproductive rights and protect access to safe and legal abortion.
Continuing, the fact sheet goes on to list what Biden aims to do with the executive order, providing that its four goals are:
- Safeguarding access to reproductive health care services, including abortion and contraception;
- Protecting the privacy of patients and their access to accurate information;
- Promoting the safety and security of patients, providers, and clinics; and
- Coordinating the implementation of Federal efforts to protect reproductive rights and access to health care.
It goes on to give numerous examples of what Biden is demanding the Director of Health and Human Services do, saying, for example:
Protect Access to Medication Abortion. HHS will take additional action to protect and expand access to abortion care, including access to medication that the FDA approved as safe and effective over twenty years ago. These actions will build on the steps the Secretary of HHS has already taken at the President’s direction following the decision to ensure that medication abortion is as widely accessible as possible.
The release of the fact sheet on the executive order and the news that Biden intends on signing that order follows a recent tweet from Biden in which he said:
If extremist governors try to block a woman from traveling from a state that prohibits her from seeking the medical help she needs to a state that provides that care, we will act to protect her bedrock rights.

Biden is expected to speak on the issue Friday morning and discuss in detail what his administration is doing to fight the Dobbs opinion and red state reaction to that opinion.
